Sheriff’s Sales Requirements
*Please be sure to include a direction sheet, containing: Attorney’s Name, Address, & Phone Number as well as directions of service or any specific instructions.*
 
Filing Requirements & Fees for Real Estate sales:
 
     1. Advance fee of $1,000.00, checks made payable to, “Armstrong County Sheriff.”
 
     2. One (1) Copy of the Writ of Execution (Mortgage Foreclosure or Money Judgement). The          back of the Writ must contain the information in the following format;

3. (1) Copy of the Notice of Sale per defendant. 

 4. (1) Copy of a complete Legal Description. The Legal Description MUST be exactly what is to recorded on the Deed. This should include a complete and current recital which clearly states the transfer from the prior owners to the current owners in default, along with any information regarding deceased, divorced, or otherwise divested owners if the listed on the mortgage are not all listed as defendants in the case.  **Please Note: The Deed will include the Township/Borough Number Before the Tax Map and Control Numbers.**

 2. (1) Copy of the Short Description for Advertising. Please note that Short Descriptions will be generated in the following format for Advertising: However, you may request special advertising by contacting the Sheriff's Office. Please include an assessment control number or map number.

 3. One (1) copy of the Affidavit Pursuant to Pa. R.C.P. Rule 3129.1
 
4. For Mortgage Foreclosures only, One (1) copy of the Act 91 Certification (If Applicable)
 
5. For Money Judgements only, one (1) Notice Pursuant to Pa.R.C.P. 3252 attached to the Writ of Execution, and one (1) copy of the Act 91 Certification stating that it does not apply.
 

6. All applicable proofs of service of the Notice of Sale upon all lienholders and defendants, if you have not requested that we serve the Notice of Sale upon defendants. These proofs of service must be received by the Sheriff’s Office prior to the sale and said service must meet the requirement of Pa.R.C.P.3129.2.

**PLEASE NOTE THAT IF WE ARE NOT SERVING THE DEFENDANT(S) WE REQUIRE AN AFFIDAVIT OF SERVICE **

**THIS OFFICE DOES NOT MAIL OUT A COPY OF THE NOTICE OF SHERIFF'S SALE OF REAL ESTATE UNLESS SPECIFICALLY REQUESTED BY THE PLAINTIFF. ALL MAILINGS MUST BE DONE BY THE PLAINTIFF. THIS INCLUDES ANY MAILINGS REQUIRED BY AN ORDER OF COURT.**

 
7. If applicable, one (1) copy of the Court Order dismissing any Bankruptcy proceeding involving the defendant’s property. Printouts of PACER docket entries are not sufficient.
 
8. If applicable, an Order of Court granting special service, granting plaintiff permission to obtain service of the Complaint and Notice of Sheriff’s Sale as authorized by Pa.RCP.(c)(1)(I)(c), such as posting the premises.

*All Certificates of Filing for Continued Sales must be filed in original form.  No faxed copies will be accepted.*
 

 
Recording Instructions for Corrective Deeds
 
 Please submit the following:
1.   Cover letter stating the requested correction.
2.   One (1) copy of the prior recorded deed.
3.   One (1) copy of the prior recorded Reality Transfer Tax Statement of Value Form
4.   Two (2) copies of a new completed Reality Transfer Tax Statement of Value Forms with the        following exemption box checked:
 
• Corrective or confirmatory Deed
 
5.   The following checks made payable to the following parties:
       $30.00  Armstrong County Sheriff
       $88.75 Recorder of Deeds, Armstrong County (If your original Deed was more than               $86.75 then add $2.00 to the original cost.)

1    This is Prothonotary’s standard fee for a Sheriff’s Deed
2.   This is the Sheriff’s standard fee to execute and acknowledge a Sheriff’s 
      Deed, set by the Sheriff Fee Act
3.   The Recorder’s fee for a standard five-page Sheriff’s Deed is $86.75. There
      is an additional $2.00 fee for Corrective Deeds. The Recorder’s fee may be
      higher if you have a legal description of more than one page, or with more
      than one parcel or more than four names listed.
